Terms of Service

1. Agreement

These Terms of Service ("Terms") are a legal agreement between you ("you" or "Merchant") and Fractal Grid, LLC ("Fractal Grid," "we," "us," or "our"), the operator of Halal Rewards Club. By creating an account or using Halal Rewards Club (the "Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

Halal Rewards Club is a digital loyalty program platform designed for halal restaurants, cafes, bakeries, and similar food businesses. The Service allows Merchants to enroll customers into a points-based loyalty program, track visits, issue rewards, and view analytics through a web-based dashboard.

3. Accounts

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@halalrewards.club if you suspect any unauthorized use of your account. You must be at least 18 years old and authorized to operate the business you register.

4. Customer Data

As a Merchant, you will collect personal information from your customers (including names and phone numbers) through the Service. You are solely responsible for obtaining any required consents from your customers and for complying with applicable privacy laws. You grant Fractal Grid a limited license to process this data solely to provide and improve the Service. We do not sell your customers' data to third parties.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure.
  • Reverse engineer, decompile, or disassemble any portion of the Service.
  • Use the Service to send unsolicited communications to customers.
  • Misrepresent your identity or affiliation when using the Service.
  • Interfere with or disrupt the integrity or performance of the Service.

6. Subscription and Payment

Access to the Service requires a paid subscription. Subscription fees are billed in advance on a monthly basis. All fees are non-refundable except as required by law or expressly stated otherwise. We reserve the right to change pricing with at least 30 days' notice. Failure to pay may result in suspension or termination of your account.

7. Intellectual Property

The Service, including all software, designs, text, and graphics, is owned by Fractal Grid and protected by intellectual property laws. These Terms do not grant you any ownership rights in the Service. You retain ownership of any data you upload to the Service.

8. Termination

Either party may terminate this agreement at any time. You may cancel your account through the dashboard or by contacting us. We may suspend or terminate your account immediately if you violate these Terms. Upon termination, your access to the Service will cease. You may request an export of your data within 30 days of termination.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRACTAL GRID SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Texas.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through a notice in the dashboard. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
